The electoral day of 23-J has already finished and the provisional results are beginning to be known, but the final results will not be published until days later. On election night, the provisional results are known, which are normally no different from those obtained after the scrutiny carried out at the polling stations and offered by the Electoral Boards. However, these are not considered the official ones. The law requires this subsequent recount of votes to verify and give greater security to the elections.
The definitive scrutiny is carried out on the third day following the voting by the Electoral Boards and must conclude no later than the sixth day after the election. It is a unique and public act. Once the final results are obtained, the Electoral Board will proceed to proclaim those elected and publish these results in the Official State Gazette (BOE) within a period not exceeding 40 days, as established in the electoral calendar.
Before beginning the scrutiny, the competent Board will constitute a table for the counting of votes of those registered in the CERA. The president will introduce the voting envelopes received until then into the ballot box and the secretary will write down the names of the voters on the list. Next, the Board will scrutinize the votes and incorporate them into the rest of the results.
With the opening of the envelopes that will have been delivered to the courts at the end of the day, the scrutiny session will begin. The Board will limit itself to verifying the count and the sum of the votes in the tables according to the minutes. You cannot annul any act or vote. If there is a material error, it will be corrected. The scrutiny act, which cannot be interrupted, must conclude before the eighth day after the elections. The Board counts the votes and incorporates the results into the final scrutiny.
