Sentenced to prison for breaking the jaw and nose of a Tudela Police sub-inspector

Sentenced to prison for breaking the jaw and nose of a Tudela Police sub-inspector

The Criminal Court number 6 of Zaragoza has sentenced Iván OM, the 40-year-old man who seriously assaulted an off-duty national police officer and fractured his jaw in Zaragoza, forcing him to undergo surgery and causing him three months off work, as the Heraldo de Aragón has advanced.

The attacker has accepted a sentence of 18 months in prison (nine months for the crime of attack and another nine for injuries) after having fractured his jaw in three places on October 12, 2021 and breaking the nose of a sub-inspector with a kick of the National Police of Tudela.

The agent José Luís R., who was off duty that day in Zaragoza, asked the man to move away from the curb of the sidewalk on which he was sitting to be able to park his car, according to the Aragonese newspaper. The agent's request would not have sat well with the aggressor, who, getting up from the ground, kicked the vehicle door and another at the rear-view mirror.

The violent reaction of the convicted person provoked the reprimand of José Luís, who did not believe the situation. The attacker's response was to punch the driver, a first blow that he managed to dodge. Not so the second, when the attacker pushed him without actually knocking him down. Immediately afterwards, José Luís, a native of Zaragoza, identified himself as a police officer stationed in Tudela (Navarra), something that did not intimidate the assailant and prompted him to push him again, ending up with the victim on the ground. Iván OM took advantage of that moment to release an "unjustified, disproportionate and surprising" kick in the face, as stated in the sentence.

This attack caused him not only to break his glasses, but also caused several fractures to his nose and a triple jaw fracture, the healing of which required several medical assistance and surgical intervention. In addition, El Heraldo reports that the agent needed 92 days off work to fully recover and he has been left with osteosynthesis material in the osteoarticular system.

The private prosecution, exercised by Pilar Sangorrín – a lawyer for the Unified Police Union (SUP), accused the aggressor, in addition to the two aforementioned crimes, a third of hate crimes. In total, the sentence amounted to 8 years in prison. Finally, the parties reached a prior agreement and the attacker accepted a sentence of a year and a half in prison and, in addition, he will have to compensate the policeman he attacked with 14,600 euros and will have to bear the costs of the private prosecution.
