The TSJCV confirms the acquittal of Rodríguez and the other 13 defendants in the Alquería case

The Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community (TSJCV) has declared final the sentence handed down on December 12, which in turn confirmed the ruling of the First Section of the Provincial Court of Valencia by which All the accused in the so-called 'Alquería case' were acquitted.

The TSJCV has made this decision once the legal deadlines have elapsed without the appeal ruling having been appealed in cassation before the Supreme Court, as confirmed by sources from the Valencian high court.

In this way, the acquittal of the 14 accused is declared final, among them, that of the former president of the Valencia Provincial Council for the PSPV and mayor of Ontinyent for Ens Uneix, Jorge Rodríguez, who has spoken about this declaration of finality in a message on his X account: "I thought this day would never come...".

Rodríguez and the rest of the defendants - for the crimes of prevarication, embezzlement and falsification of documents - were tried in relation to senior management contracts in the public company Divalterra (formerly Imelsa) between the years 2015 and 2018. The Court acquitted May to all of them, a decision that the Anti-Corruption Prosecutor's Office appealed to the TSJCV, a body that rejected their arguments and confirmed the decision of the first instance court.

The Court decided acquittal as it saw no crime in the actions of those then accused in relation to the hiring of senior managers in the public company Divalterra between 2015 and 2018 supposedly to favor people related to PSPV and Compromís: neither administrative prevarication, nor embezzlement. of public funds or documentary falsification.

The accusations maintained that the top officials of Divalterra designed an artificial system of management areas in this company solely to favor members, associates or sympathizers of the political parties that then ran the provincial corporation, PSPV-PSOE and Compromís.

The trial for these events began in September 2022, almost four years since the start of the case, and concluded on November 30. The process began with a complaint from the Anti-Corruption Prosecutor's Office, after previous complaints from two former directors of the public company dependent on the Provincial Council and already liquidated.

Rodríguez faced the sentence of eight years in prison, as demanded by the accusations - Prosecutor's Office, Acción Cívica and PP -, while his defense requested acquittal.

The accusations also requested eight years in prison for his former chief of staff, Ricard Gallego; for the advisor Manuel Reguart (both for necessary cooperation) and for the two former managers of Divalterra (formerly Imelsa), Agustina Brines (for Compromís) and José Ramón Tiller (for the PSPV) for administrative prevarication, misappropriation of public funds and falsification of documents official.

In addition, the prosecutor requested six years in prison for the seven people hired as senior management positions: one for falsifying documents and five more for embezzlement of funds due to necessary cooperation; and another six for Divalterra's lawyer-advisor, Jorge Cuerda, and another manager, Xavier Simón, for falsehood, embezzlement and prevarication.
