The Court of Barcelona has annulled the sentence that condemned the stalker of Paula Bonet to remain confined in a psychiatric center. According to the court, the reasoning of the sentence presents an "irremediable deficit" due to the "absence or insufficiency of an entirely relevant test", which is why it requires that the sentence be repeated again, further justifying the exemption of mental disorder. The sentence against Victor Galindo sentenced him to serve three years and three months in a psychiatric center.

In its ruling, the court considers that "The application of a complete defense of mental disturbance requires a high degree of motivation." In this case, he considers it necessary to "develop the argument that makes us understand what type of pathology is the erotomanic delusional disorder" suffered by the defendant, and what is "the causal relationship between the disorder" and the harassment suffered by the victim, Paula Bonet.

This decision supports the appeal filed by the Prosecutor's Office, which considers that the stalker's mental disorder was not proven during the trial, so he should not enjoy any extenuating and exemption, for which reason he requested his imprisonment. In addition, the internment in a psychiatric hospital, the sentence of court number 10 sentenced the defendant to more than a year of probation, external psychiatric treatment and 5 years without approaching the victim.
