133 years of sentence for distributing child pornography and abusing minors in Benidorm

A 27-year-old British citizen residing in Benidorm has been sentenced by the Alicante Court to sentences totaling 133 years in prison as the author of several crimes of distribution and production of child pornography, cyberbullying, corruption of minors and even , of sexual abuse committed on minors who appeared in some of those videos.

However, the judicial resolution establishes that the maximum effective completion of the sentence will not exceed three times the time imposed for the most serious penalty, so the maximum deprivation of liberty in this case is set at 20 years.

The commission of these crimes would have occurred between 2019 and 2020, when the accused shared different images of naked minors or engaging in sexual practices on a child pornography forum.

According to the initial indictment of the Prosecutor's Office, the defendant contacted 27 minors whom he proposed to expose themselves naked or masturbating and managed to get 13 of them to agree to his requests. Thus, the Prosecutor's Office initially requested that a sentence be imposed for a total of 211 and a half years in prison.

For his part, the defendant denied during his statement at the trial, held on November 7, that he had recorded the videos stored on two hard drives and on a mobile phone seized during the search of his home, in the municipality of Benidorm. .

Along these lines, he only partially assumed the facts by acknowledging that he had videos and images of pedophile content after having downloaded them from the dark web “for his own consumption.” In other cases, according to him, this material was sent to him by third parties via email or the Telegram smartphone application.

He also denied that he had distributed this pedophile material over the Internet and that he had not dedicated himself to capturing the young people who appeared in the images to convince or extort them to record those videos in which they appeared naked or engaging in sexual practices.

However, the court does not give credibility to his testimony by emphasizing that, in his previous statements before the court, he had assumed responsibility for a large part of the events for which he was put on trial.

Furthermore, the Court of Alicante states that the authorship of the events would be demonstrated from the abundant evidentiary material reflected in the expert reports on what was intervened in the hard drives found at his home and in the record of his internet browsing with code names. which the accused admitted having used.

Apart from serving the maximum sentence of 20 years in prison, the ruling establishes that the accused must compensate three of the minors on whom he committed abuse in the amount of 6,000 euros for each of them. The sentence can be appealed before the Superior Court of Justice of the Valencian Community (TSJCV) within a period of ten days from its notification.
