The judge has asked the Barcelona City Council to identify the person responsible for the maintenance of Carrer Aragó in order to cite him as being investigated for the fatal accident of the boxer Xavi Moya.

The judge quotes the head of maintenance of the street where Xavi Moya died

The judge has asked the Barcelona City Council to identify the person responsible for the maintenance of Carrer Aragó in order to cite him as being investigated for the fatal accident of the boxer Xavi Moya. The head of court number 17 of Barcelona has issued an order in which he demands the Council to notify him of the name of "the person responsible for signaling, conservation and maintenance of the road where the accident occurred on October 7, 2023, with the aim of taking his statement as investigated". The information was provided yesterday by the Vosseler law firm, which has taken over the representation of the Moya family and which stressed that, "in judicial history, a municipal official had never been cited for the your possible responsibility in a traffic accident".

The magistrate wants to hear the explanations of this municipal official after receiving a report from the Urban Guard in which the cause of the accident was pointed to the collision with a rubber element on the roadway of an old bike lane that had not been removed nor was it marked. These explanations from the local police were, in the opinion of the victim's lawyers, evidence that the accident was not the boxer's fault and that the City Council could have been grossly negligent for not having removed these elements from the roadway .

The ex-boxer Xavi Moya, 55 years old, was driving a motorcycle when he was driving down Carrer Aragó at the height of Carrer Sicília. He ran into a corner where a bike lane had been disabled, but where a protective rubber element had not been removed. Moya collided with the obstacle, which caused his death. "The cause of the accident was poor signaling and placement of the rubber element at the intersection of Aragó and Sicília streets. It was a deadly trap", say the victim's lawyers, who attribute responsibility to the City Council "for the poor state of conservation of one of Barcelona's main arteries". Then, according to the law firm, 14 accidents were registered at this same point - seven of motorcyclists -, without consequences as serious as that of the boxer. However, the Guardia Urbana has only accounted for one incident.

Boxer Xavi Moya was a three-time champion of Spain at middle weight and world and European champion in kung fu and full contact.
