Designer Katie Perry beats Katy Perry in court and will use her name as a trademark

Katie Perry is in luck. Not Katy Perry the American singer, but Katie Perry the Australian designer who has managed to beat the international pop star in a legal battle after she infringed the trademark of the fashion designer, who sells her products locally under her own brand, "Katie Perry".

Katie Taylor - whose real name is Katie Perry, under which she has her brand -, the designer who filed the lawsuit in 2019, alleged that the singer deliberately ignored her trademark and sold "Katy Perry" clothing to Australian customers. during their concerts in the country from 2014 to 2018 through various web pages.

Federal Court Judge Brigitte Markovic ruled that Katy Perry's company, Kitty Purry, had partially infringed the trademark of the plaintiff's business, Katie Taylor, which primarily sells its products over the Internet. Thus, she dismissed the petition of the artist, who sought to cancel the "Katie Perry" trademark.

Compensation for damages will be ruled later, but the judge determined: "This is the story of two women, two teenage dreams - he said, referring to the success of the singer Teenage Dream - and a name."

Taylor, the victor in the lawsuit, called the verdict a "David vs. Goliath" victory for small businesses.

"Not only have I fought for myself, but for all the small businesses in this country, many of them started by women who can find themselves facing entities that have much more economic power than we have," Taylor narrates, in her blog.

The fight between the artist and the Australian designer began in 2008, when the fashion creator registered her brand "Katie Perry" in Australia. The artist tried to block this process, even sending documents to the designer through her legal team to stop her attempts. However, she soon gave up on her, seeing that Taylor stood up to her on her case, moving on to the legal process that has now obtained her verdict.
