A Vizcaya court has considered it proven that two women, who were in a sentimental relationship, continuously abused the son of one of them, a minor under 9 years of age at the time of the events, whom they forced to participate in their sexual practices. The boy later repeated these sexual behaviors with his sister, a 7-year-old girl, which would end up uncovering the previous case of abuse. The two women have been sentenced to 11 years and six months in prison, in the case of her mother, and 11 years, in the case of her partner, who could also be deported to Venezuela for being in an irregular situation.

The sentence in this case, investigated by a Gernika Court, states that from the end of 2017 to the end of 2018 the minor suffered continuous sexual abuse by his mother, who had separated from the minor's father and was in a relationship with another woman. .

The women forced him to undress and participate in their sexual practices, according to the proven facts of the court ruling.

Without knowing that he was being the victim of sexual abuse, representatives of two Bizkaia town halls where the women lived and of their school reported to the Provincial Council the "serious situation of lack of protection" in which the two children found themselves, whose mother was a regular consumer of alcohol and other substances.

The Provincial Council forced the mother to participate in a family intervention program, which was unsuccessful, and subsequently withdrew custody of the children, which passed into the hands of the father.

In August 2019, however, the events occurred that would end up uncovering the abuse by the mother of the minor and her partner. The father found that the minor was sexually abusing his sister, two years younger, in what the court has considered a "manifestation of traumatic repetition." The parent asked the Provincial Council to take care of the minors, who went on to live in a sheltered home.

The mental health services that treated the young man found that he suffered from anxious-depressive symptoms as a consequence of a severe emotional disorder, which are likely to last in the medium and long term and influence the configuration of his personality and mental balance.

The Provincial Court of Bizkaia has given credibility to the testimony of the boy, who on July 21, 2020, when he was already 12 years old, declared that his mother continuously abused him with his partner, while he cried.

The two women, who have been convicted of a continued crime of sexual abuse with carnal access, must also jointly compensate the minor with 90,000 euros.

Nor will they be able to communicate with the minor, or come within 500 meters of the boy, in a period of fifteen years, and they must participate in a sex education program after their release from prison.

In addition, the mother of the minor and her partner will be disqualified for a period of 15 and 9 years, respectively, for the exercise of any profession that requires the approach of minors.

The ruling also determines that once the administrative situation of the mother's partner, who arrived from Venezuela, has been ascertained, "whatever proceeds in relation to the request for their expulsion" will be agreed upon.
