A mother from Vitoria-Gasteiz has been convicted of "a crime of sexual exploitation and corruption of minors in the form of distribution of child pornography", after sending her former lover intimate photos of her daughter, only three years old. This other person, her mother's ex-partner, has also been convicted as an "inducer" of the crime. The mother will be prohibited from seeing or speaking with her daughter, who is now seven years old and lives in the custody of the Diputación de Álava, for the next 30 months.
This part of the sentence will be the one that will have the most obvious consequences. Not surprisingly, the woman has also been punished with a year and a half in prison, but she will not go to jail as she has no criminal record. In addition, she has been sentenced to four and a half years without being able to perform "any job" that involves contact with minors. The Court also reserves the option of expelling her from the country as she is of foreign origin.
The instigator of the crime, who deposited 6,000 euros for the victim, has been sentenced to one year in prison and four years of veto for any work related to minors.
The news has been released by El Correo and dates back to events that occurred at the beginning of 2020 and now judged.
The account of the facts is as follows. Her mother worked for a time as a domestic worker for the other convicted person and, afterwards, she continued to have a sporadic relationship with this man. The condemned, however, was replaced by another woman, who began working as an intern. This last person was key to uncovering the crime.
According to the sentence, the man's new housekeeper listened to a telephone conversation from his employer in which he asked the now-convicted woman for intimate photos of her daughter. The other woman knew the girl, since she still visited the man's home because of the relationship that her mother had with her employer.
From there, the new housekeeper entered the man's computer and discovered the infamous crime. According to El Correo, the woman took several photographs on the computer and went to the Ertzaintza.
The investigation turned out to be more complicated than expected for the agents, since the man deleted the images, which had to be recovered by specialized ertzainas.
The Provincial Court of Álava has determined, in any case, that the evidence found, the look of the photographs and the first statements of the convicted evidence the crime.
"In the case at hand, the circumstances in which the photographs were sent and the level of detail clearly show that they were intended for the sexual enjoyment of the recipient," the resolution estimates. The sentence can be appealed to the Superior Court of Justice of the Basque Country.
