The Provincial Court of Almería has sentenced B.N.A.A. to 20 years in prison and one day. for commissioning D.V.G., on whom she imposes 16 years in prison, the murder of her husband on August 13, 2021 in exchange for 1,000 euros, taking advantage of the fact that he was alone in his farmhouse in 'Los Cabecicos' in Huércal-Overa (Almería) , where his body later appeared with more than thirty stab wounds.

In accordance with the guilty verdict issued by a jury, the magistrate-president, María Soledad Jiménez de Cisneros, condemns the defendants for a crime of murder in which, in the case of the woman, there is an aggravating circumstance of kinship. There is an appeal against the ruling before the Superior Court of Justice of Andalusia.

The jury considered proven after the trial that the woman charged the family friend with the murder of her husband, with whom the relationship had cooled over the years, after suspecting that he had the intention of divorcing her to marry with another person, according to the defendant, with one of her daughters from a previous relationship.

Thus, the day before the crime, around 3:00 p.m., the woman was left with a hitman who proposed to end her husband's life in exchange for 1,000 euros, which he accepted. Likewise, both specified the modus operandi the following day while the condemned woman's husband was in her farmhouse. In this sense, the sentence includes that planning "the intention of giving him a lesson consisting of killing him or at least representing such a possibility."

To make sure that the victim was alone in the farmhouse, the defendant made a call, later notifying the hitman that he had a free hand to go to the property. The reports on the position of mobile phones, the call log and the capture of images by traffic cameras were decisive for the jury when it came to issuing her verdict.

Thus, around 1:15 p.m. on that same August 13, the defendant went as agreed in search of his friend's husband, on whom he "pounced on with the intention of causing his death", for which he struck him. multiple stab wounds with a knife about 12 centimeters long in the chest, right thigh, arms, right hand, head, and back.

The wounds caused the death of the man in a short time due to the "violence" of the attack, who suffered two of the stab wounds to the chest, which necessarily caused his death from hypovolemic shock. In this line, they rejected the thesis that the man only tried to "injure" the victim to give him a "scare", as the woman maintained during the trial.

Based on this initial intention to kill the man and the recognition that the payment of 1,000 euros was agreed, although it was later alleged that it was "for gasoline", it is also considered proven that a crime of planned murder and low price took place.

The sentence also includes the absence of extenuating circumstances despite the fact that the woman went 19 days after the crime to confess the facts before the Civil Guard since, by then, the investigators had already narrowed the siege on the family.

Likewise, in her statement, the woman omitted to mention the telephone number that she kept hidden and with which she contacted the hitman "with the purpose of evading his criminal responsibility." "She stopped collaborating with the judiciary, making the investigation tasks difficult," she points out in her foundation.

The verdict also rejected the mitigation of psychological anomaly on the woman as there was no mental disorder with sufficient forcefulness that could mitigate her criminal responsibility. The existence of immediate external stimuli that provoked in the defendant an "obcecation" that led her to undertake the facts was also rejected.
