The TAD has the CSD in suspense for Luis Rubiales

Compass of waiting in the will of the Government to provisionally suspend Luis Rubiales. The Higher Sports Council (CSD) wanted the process to really start once the Administrative Court of Sports (TAD) decided to initiate a file against Rubiales. However, at its meeting yesterday, the TAD studied the CSD's complaint but did not resolve it. According to progress, the legal portal Iusport requested more information before making a decision on the matter. However, CSD sources consulted this Monday night by this newspaper indicated that they were not yet aware of this request.

On Friday the CSD transferred a single complaint argued to the TAD for a possible violation of articles 76.1.a of the Sports Law and 14.h of Royal Decree 1591/1992 by the president of the RFEF until Saturday. In the opinion of the Higher Sports Council, both infractions are considered "very serious", which makes it possible to adopt a provisional precautionary suspension measure for Rubiales as a result of his unacceptable behavior during the World Championship final. Article 76.1.a of the Sports Law refers to abuses of authority and article 14.h of Royal Decree 1591/1992 affects notorious and public acts that violate sporting dignity or decorum.

If the TAD's request for more documentation is confirmed, this could lead the CSD to file the rest of the complaints against Rubiales, the president of the Cenafe coaching school, Miguel Galán, Sumar, the former collegiate Estrada Fernández or the of the women's soccer league.

The truth is that the Administrative Court of Sport has not resolved and the president of the CSD, Víctor Francos, has not been able to announce that he would urgently convene the board of directors of the organization to proceed with the provisional suspension. FIFA was the one that already cautiously punished Rubiales for 90 days last Saturday.

Víctor Francos had called a press conference for 6:30 p.m. yesterday. He showed up at 6:55 p.m. but was unable to provide the information he wanted. “The Court of Arbitration for Sport (TAD) is still meeting, we respect its deliberation times and its independence, there would be more to go. I don't know any member of the TAD,” said Francos, who insisted on the independence of the body made up of seven people with law degrees. He is, in fact, the only one in charge of processing and resolving disciplinary files at the request of the president of the CSD or its Sports Commission. If, when it has all the documentation, the TAD decides to open a disciplinary file against Rubiales, the CSD may dismiss him provisionally until the TAD issues a sentence.

Francos answered questions without having the basic information but did express his point of view. In this sense, he did show his concern for the future of the candidacy of Spain, Portugal and Morocco for the 2030 World Cup, which has to be chosen next year. “Two weeks ago we were in a better position for the 2030 World Cup than we are now, but we will explain to FIFA that neither Spanish sport nor football are what we have seen these days. Spanish soccer is the 23 champions. We are ready to fight for 2030. I have spoken with the FIFA vice president, that they have confidence in the Government, a particular fact cannot tarnish a collective success”.
