The Vacation Chamber of the Constitutional Court agreed in the month of August, with the support of two judges from the conservative sector and a dissenting vote against a judge from the progressive wing, to reject the admission of Puigdemont's appeal against the national arrest order that he issued. the Supreme Court confirming his prosecution for aggravated embezzlement and disobedience in the 'procés' case, after the crime of sedition was repealed.

The prosecutor appealed the resolution considering that this matter should not have been resolved by the vacation room on August 9 as this month was a non-working month and it was not a matter of urgency to convene said room.

For the Prosecutor's Office, the room did not adhere to the "true tenor" of the agreement to convene the vacation room and was "devoid of its logical, systematic and teleological context," he would allow.

In his opinion, assuming this argument of jurisdiction "if generalized as a doctrinal criterion, would produce application consequences that are hardly compatible with the Court's own institutional and constitutional configuration."
