The National Court asks the Prosecutor's Office if it is competent to investigate the PSOE, Junts and ERC for the amnesty law

The National Court has asked the Prosecutor's Office if it is competent to investigate the PSOE, Junts and ERC as a result of the amnesty law, after the Christian Lawyers association filed a complaint last March against the promoters of the measure.

In the document, to which ACN has had access, the head of the Central Court of Instruction number 3 indicates that the facts described in the complaint "present characteristics that lead to the possible existence of a criminal offense."

The magistrate agrees in the letter to initiate preliminary proceedings and passes the case to the Public Prosecutor's Office, so that it can report on whether it is competent and, where appropriate, on the proceedings that should be carried out.

Regarding the only legal reasoning included in the text, the judge indicates that neither the nature nor the circumstances of the events reported by the association of lawyers are determined, nor are the people who could have intervened.

For this reason, it is considered that prior procedures must be carried out and the "essential" ones carried out to determine these aspects, and, where appropriate, the procedure to be applied.
