The Alicante Court has imposed nine years and one day in prison on two men, the grandfather and great-uncle of a minor, for sexually abusing her when she was only 14 years old.

The Court of the Eleventh Section considers it proven that the two accused, aged 39 and 57, both of Ecuadorian origin, took advantage of the family bond that united them with the victim to perform various touching on her breasts and genitals. The abuses occurred during two weeks in April 2020, in full confinement due to covid-19.

The sentence details that the girl was in the custody of her maternal grandmother, spending long periods in Ecuador, without having much of a relationship with her father. However, in April 2020 he returned to Spain to settle in his father's home, located in a municipality in the Vega Baja region of Alicante, and ended up living with him, his partner, his paternal grandmother and his uncle. grandfather for two weeks.

At the trial, the minor's father denied sexual abuse and attributed his daughter's accusations to the existence of alleged jealousy towards her stepbrother.

However, the court considers the existence of the abuse proven based on the victim's testimony, after concluding that her story was persistent and credible and that, in addition, it had been supported by her mother's statement and the conclusions collected in two psychological expert reports.

The Court of Alicante imposes on the two accused sentences of nine years and one day of deprivation of liberty for the commission of two continuous crimes of sexual abuse, in addition to the measure of removal for fourteen years with respect to the victim, as well as another eight years of probation.

It also establishes that each of the two defendants must compensate the minor with 3,000 euros for the moral damages caused. The ruling can be appealed before the Superior Court of Justice of the Community (TSJCV).
