Dani Pedrosa wins his fight against the Treasury, which will have to return 3 million euros

Dani Pedrosa (38 years old) has emerged victorious in his race against the Tax Agency. The Spanish treasury will have to return 2,418 million euros, plus late payment interest (about 600,000 euros), that is, around 3 million euros, corresponding to the settlement of the income for the years 2005 and 2006, which it had claimed. because he understood that he resided in Spain.

The National Court, in a ruling dated November 16, upholds the contentious administrative appeal filed by Dani Pedrosa against the initial sanction, concluding that the Treasury inspectors have not been able to prove that the KTM test rider lived in Spain. His tax residence in those years, and currently, is set in Switzerland.

As Dani Pedrosa's lawyer, David Gil, from the firm AYG Asesores, based in Barcelona, explained to La Vanguardia, this latest ruling by the National Court - against which there is an (unlikely) appeal before the Supreme Court - puts an end to to all the cases opened against the pilot by the Tax Agency, in what the lawyer considers "aggressive and kamikaze inspections" against his client.

A fiscal persecution that "has entailed late payment interest payments that all taxpayers pay; so the Tax Agency should be more careful" in its actions, due to the expense it causes to public coffers, in addition to "ruining the reputation " of many athletes and other public figures.

Previously, Sito Pons, Sete Gibernau and Jorge Lorenzo were also acquitted or compensated for the KTM rider.

In the case of Dani Pedrosa, the other three previous procedures (for the settlements of the IRFP of 2008-09, of 2011-14 and of the wealth tax of 2013-14) ended with a sentence to the Treasury to return the amounts paid by the pilot: more than 22 million euros, plus the corresponding late payment interest (about 4 million); That is, a total amount of about 26 million euros. With the 3 now, the amount to be returned will have been around 30 million euros.

Dani Pedrosa, retired since 2018, and now a KTM tester for the MotoGP team, I was included in a list of defaulters made by the Tax Agency, with about 5,000 debtors. He demanded 7.8 million euros from the Castellar del Vallès driver.

Pedrosa, through his lawyer, has reported having been the subject of a campaign of persecution with "unpleasant episodes" of harassment by Tax Agency agents with coercive messages to his relatives.
