The investigative court number 47 of Madrid has agreed to open an oral trial against Luis Medina and Alberto Luceño for what is known as the Mask Case, the alleged scam against the Madrid City Council in the sale of medical supplies during the most critical moments of the pandemic. The Prosecutor's Office, in its indictment, requested 15 years in prison for the businessman Luceño and another nine for the aristocrat.
For Luceño, the investigating court has agreed to open an oral trial for a continuing crime of aggravated fraud, a continuing crime of falsifying a commercial document committed by an individual, and another continuing crime of falsifying an official document committed by an individual.
In the case of the son of the Duke of Feria and Naty Abascal, an oral trial is opened for a continuing crime of aggravated fraud and for a continuing crime of forgery in a commercial document committed by an individual.
The competent body that will prosecute the Masks case will be the Provincial Court of Madrid. There is no appeal against this resolution. And it requires that both defendants provide bail within one day for civil liability that totals more than 7.8 million euros.
He also requests that Luceño contribute 1.3 million euros to ensure the liabilities that may arise, warning that "if he does not provide it, assets in sufficient quantities will be seized to ensure the indicated sum."
The judge also decrees the confiscation of the assets currently seized, as well as any other assets that the defendants have up to the amount of 4.6 million euros in the case of Alberto Luceño and the amount of 912,700 euros in the case of Luis Medina. .
This resolution, against which there is no appeal, comes after the Third Section of the Provincial Court of Madrid has rejected the last appeals, confirming the instruction developed by the magistrate.
In view of the future trial, the Prosecutor's Office requests a sentence of fifteen years in prison for the businessman Alberto Luceño and another nine years in prison for the aristocrat Luis Medina. In addition, the Prosecutor's Office requests a total fine of 5.6 million euros for Luceño, while for Medina it requests 450,000 euros.
It also demands that both jointly and severally compensate the Municipal Funeral Services Company of Madrid, which was the one that formalized the purchase, with a total of 7.8 million euros, an amount corresponding to the commissions they earned and the extra price paid by the City Hall, among other concepts.
In the case of Luceño, the Prosecutor's Office also orders that he pay 1.3 million euros to the Treasury if the court considers that he should have paid taxes on the commissions he obtained.
The Madrid City Council, the accused in the procedure, requests that Luceño be sentenced to 11 years in prison and a fine of 600,000 euros, while for Medina it requests 9 years and 450,000 euros, and that both jointly compensate the Funeral Services Company with 7.9 million euros.
