The causes for flagrant racism in Spanish football that have already been filed

Since the creation of the LaLiga Integrity and Security Directorate (2015/16) more than a dozen racist incidents linked to LaLiga parties have been confirmed. All the cases have been investigated and/or reported to the Prosecutor's Office by LaLiga, as explained in a statement issued this morning, but several of them have been archived.

Of the thirteen complaints that the League has transferred to the Prosecutor's Office since 2018, in nine of them Vinícius has been the victim who received the racist insults. But Iñaki and Nico Williams, Carlos Akapo and Samu Chukweze have also been wronged. Of all these cases transferred to the Prosecutor's Office, five of them are still being investigated, in four proceedings have already been opened against those responsible and another four were filed by the Prosecutor's Office, despite the fact that the racist insults were proven.

The first case filed corresponds to the insults that Vinicius Jr. received at the Camp Nou during a classic in 2020. The Prosecutor's Office filed the complaint "since the identification of the perpetrators of the events" was not achieved by the police authorities. In another later case, in Mallorca, the Prosecutor's Office argues to archive the case, that "the expression and sounds uttered, undoubtedly typical of profane and despicable attitudes, as well as vexatious and absolutely rejectable, do not initially seem to cover, for the present case, the public penal dimension that is postulated”.

The case for the racist insults against Nico Williams at the Benito Villamarín was also dismissed. "Despite not having declared, from the study of the defendant's social networks, it seems to be clear that he is not a person who intends to incite racism," said the Prosecutor's Office at the time, and therefore, "despite their incorrectness, they do not cross the line of criminal offence”.

Finally, the case for the racist shouting against Vinicíus in the Metropolitan was also filed because there was no "specific act to impute to a certain person and once the insults of a racist nature were contextualized, they would not constitute a crime against the dignity of the person either. […] since they were spilled on the occasion of a soccer match of maximum rivalry, together with the fact that they were not reiterated and that they lasted a few seconds ”, they clarify.

In the case of racist insults by fans to players, in addition to reporting the facts to the aforementioned State Commission, since the 18/19 season, LaLiga has also brought these cases before the Hate Prosecutor's Office. Recently, due to the filing of some LaLiga complaints by the Prosecutor's Office, and due to the lack of uniformity in the motivations, LaLiga has decided to file a complaint directly before the investigating courts.

Regarding the administrative sanctions to be applied, LaLiga explains that the sanctioning competence corresponds to the Government Delegation, the Secretary of State for Security, the Ministry of the Interior and the Council of Ministers, without prejudice to the possible competences of the Autonomous Communities. In the case of possible sports disciplinary sanctions, these are included in the RFEF Disciplinary Code, with the Competition Committee being competent to sanction them. Therefore, LaLiga can only limit itself to denouncing the facts.
