Salvi Güell, former mayor of Castelló d'Empúries (Alt Empordà), did not commit crimes of disobedience and prevarication in the independence referendum of October 1, 2017, as ruled by the Jury of First Instance and Instruction of Figueres, after filing the complaint that the prosecution presented in March 2019.

The substitute judge of the jury maintains, in the interlocutory published last Wednesday, that the mayor of ERC l "did not carry out any act that could be interpreted in the sense expressed in the complaint" since the investigated person "did not open the premises to carry out the activity." , nor did he make it easy for anyone else to do it.”

In the instance it is stated that the identity of the person who opened the voting centers remains unidentified, since a large number of people, entities and associations had the key to the premises. Furthermore, the judge assures that “she was not required to carry out any conduct” to prevent the elections from being opened. These types of actions “were a task of public order and therefore, police.”

Regarding the mayoral decree in support of the referendum issued by Güell, the court considers it a “mere manifestation, of a political or ideological nature that had no practical significance,” after the former mayor declared that the events occurred “before receiving the notification of the instruction of the Constitutional Court that prevented the referendum from being held,” according to Güell, after declaring at the end of October 2019.
