The Senate validates today the reform of the crime of embezzlement and the repeal of sedition

The Senate will give the green light this Thursday at noon to the reforms of the Penal Code agreed upon by the PSOE and the Republican Left, which includes the repeal of the crime of sedition -announced by the President of the Government, Pedro Sánchez, on November 10-, with changes in that of public disorder, and the modification of the criminalization of embezzlement –which has been introduced in the parliamentary process through group amendments–.

The measures introduced by the members of the central Executive to facilitate the renewal of the members of the Constitutional Court (TC) with an expired mandate and to end the blockade of the right and the conservative sector of the judicial career are outside the text that will be approved by the Upper House after the members of the TC themselves, with the help of those affected by the changes being promoted, decided to suspend the process.

These legal reforms have increased the distance and tension between the investiture bloc of the current coalition government and the rest of the opposition. The PP was negotiating with the PSOE the renewal of the members of the high court, but Alberto Nuñez Feijóo, president of the popular, decided to put these talks aside when he learned of Sánchez's plans regarding changes in the Penal Code, which will affect Everything to the pro-independence leaders who have open cases with the courts for the procés.

In addition, the appeal filed by the popular in the guarantee court to paralyze the processing of the measures related to the election of the magistrates of the TC has become an unprecedented institutional crisis in the Cortes Generales. The Constitutional Court has intervened for the first time in the middle of the process and judges affected by the measure that was trying to approve have rejected the challenges that were presented to them. Beyond the institutional crisis, the gap between the two big parties, PSOE and PP, has widened.

After the approval of the Senate, where yesterday Feijóo and Sánchez faced each other in a bitter control session, the rule will now be definitively approved after receiving the endorsement of Congress last week, although in this case with a different text already that the points relating to the members of the TC were included at that time.

Despite the blockade of the Constitutional, the Government and its usual partners are already working on mechanisms to try to approve the provisions that were challenged and paralyzed for formal reasons as soon as possible.
