Outrage over the decision of a hotelier to learn that his employee was going to the hospital: "It is forbidden to get sick"

In some sectors, temporary sick leave, even if it is due to illness, seems to be frowned upon. That is the complaint made by a hospitality employee, who claims that his boss fired him after telling her that he was on his way to the hospital, according to the X (formerly Twitter) account, Soy Camarero.

"I don't feel well," this worker explained through a WhatsApp message. Given this indisposition, he tells her that he is on his way to the hospital, to have the pertinent tests done.

However, the businessman's response is blunt: "Hello. I inform you that you are fired as of today. You do not need to send me the receipt."

The person in charge, who has no qualms about firing you even if there is a health problem involved, does not explain the reason for your dismissal. He only warns her that he will begin all the administrative procedures. "On Monday, when the agency has your documentation, they will notify you," he continues.

The businessman's response has generated controversy on social networks. Some users remember that, as established by the Workers' Statute, it is not legal to fire any worker via WhatsApp.

"Articles 53 and 55 of the Workers' Statute say that for a dismissal to have legal validity, it must be communicated in writing and in a reliable manner, that is, proven," recalls the @noticiastrabajo account.

Others go further and speak of a "null manual dismissal": "Reinstatement, procedural salaries and compensation for moral damage." "That is an unfair dismissal like a cathedral," says another.
