The National Markets and Competition Commission (CNMC) has sanctioned Cemesa Amarres Barcelona and Mooring

The body chaired by Cani Fernández approved in July 2021 the creation of a joint company between the two mooring and unmooring operators of the port of Barcelona, ​​Mooring

Competition doubted this operation due to the possibility that it would deteriorate the service provided to customers, but gave its final approval after “an intense investigation”, according to the agency at the time and after the imposition of a set of requirements for the interested parties among the that they committed to “not worsen commercial conditions and not increase prices for five years.”

Then, both companies agreed to send an annual report with the prices of the services and confidential copies of the renewed contracts so that the regulator can verify that they comply with the commitment made. But, in 2022, "they did it more than a month late," as reported this Friday by the CNMC.

According to the Law on the Defense of Competition, failing to comply with the commitments of a concentration operation, in accordance with the Law on the Defense of Competition (LDC), represents a very serious infringement by virtue of its article 62.4.c. Consequently, the CNMC has imposed a total fine of 80,000 euros on both companies.
