A 34-year-old woman has been sentenced to two years in prison for sexually abusing a 15-year-old minor in the building where his grandmother lived, in the city of Alicante.

The events occurred in the spring of 2022. The sentence specifies that, in a first meeting, which occurred between the end of February and the beginning of March of that year, the accused addressed the minor, when he was leaving the building after visiting his grandmother, to tell him that he was “very handsome.”

Then, according to the court ruling, the defendant asked him if he would kiss her, to which the teenager, who was accompanied by his little brother, answered no.

Later, around 7:30 p.m. on April 7, the defendant approached the minor on the stairs of the same building and, surprisingly, “gave him a kiss on the mouth and began to touch his chest and his private parts from above.” of clothes,” until the teenager ended up running away and entered his grandmother's house, to whom he told what had just happened to him, the ruling states.

The defendant, a native of Equatorial Guinea, denied the facts during her statement at the trial and assured that, in reality, it had been the minor who had addressed her in a derogatory manner because she was black.

However, the court of the First Section of the Alicante Court that prosecuted the events conferred credibility on the teenager's testimony by considering that it was credible and persistent since the registration of the complaint.

Thus, he points out that in his story he was precise in pointing out that, when the accused kissed him, he asked him to stop, after recovering from the state of shock that the fact of having been approached produced in him. And that, when she arrived at her grandmother's house, she told her what had happened. After her, as she stated, it was she who went to the accused's home, in the same block, to ask for explanations about the event and had a discussion with her and her husband.

The court considers that the minor's version was also corroborated by the statements offered by both his mother and his grandmother.

The ruling emphasizes that the testimonies of the victim's two relatives were conclusive compared to the statements of the accused and her spouse, who attributed the complaint to an alleged bad relationship that the minor's grandmother had with them.

In this regard, the court indicates that there is no evidence of this alleged animosity in the form of a complaint or complaint, which is why it rules out that there were spurious reasons to accuse the defendant.

For all this, the Provincial Court considers the woman responsible for a crime of sexual abuse of a minor under 16 years of age, for which it imposes a sentence of two years in prison, in addition to the measure of distance of a minimum of 500 meters from of the victim, with a ban on communicating with him for four years.

It also establishes the measure of supervised release for another five additional years, as well as the obligation to compensate the victim with one thousand euros. The sentence can be appealed before the Superior Court of Justice of the Community (TSJCV) within a period of ten days from its notification.
