For her part, the Minister of Health of the Government of Andalusia, Catalina García, has reported that her area has promoted an "internal investigation" to clarify whether the girl died as a result of "a medical error" and, in the case of If so, activate the necessary mechanisms so that a similar situation "does not happen again."

In the order, issued on July 20, the judge understands that the reported facts "present characteristics that suggest the possible existence of a criminal offense." The complaint filed by the legal representation of the girl's family, carried out by the Fernando Osuna law firm, requests that the facts be considered a "crime of homicide due to serious professional imprudence", punishable by up to four years in prison.

In addition, the parents of the deceased minor request that this professional be "specially disqualified from exercising his profession, trade or position", due to the alleged "non-observance of precautionary rules" in an "absolutely culpable action in emergency care." of the Écija Hospital, causing a delay in the diagnosis that would have been decisive in saving the little girl's life.

The girl, according to the complaint, underwent surgery on September 19, 2022 at the High Resolution Hospital of Écija to eliminate hypertrophy of the tonsil and adenoid that she suffered from and that caused nasal respiratory difficulty and night snoring, an operation that, according to the lawyer Fernando Osuna, was carried out "without a prior blood test"

The minor, according to the lawyer, was discharged hours after the intervention "without the corresponding review by the person responsible for the surgical intervention." The day after the operation, according to the family's story, the parents took the minor to the emergency room of the hospital because "she was not in good condition and could not take the antibiotics orally," to which the doctors They prescribed paracetamol in suppositories.

According to their version, the parents took the minor again to the hospital emergency room on the 23rd "because she was not speaking, she had a fever, she was pale and she was not swallowing" and at dawn on the 24th they took her "unconscious" to the hospital "with cardiorespiratory arrest." , after having suffered a serious hemorrhage at home", being diagnosed with "hypovolemic postoperative shock".

"Despite the seriousness of the situation, the minor was not transferred to the Virgen del Rocío Hospital in Seville until three hours later," indicates the lawyer, explaining that the minor finally died.

The autopsy, issued by Virgen del Rocío on October 31, 2022, indicated hypoxic-ischemic encephalopathy (encephalic death), with "concomitant alterations: hemorrhagic shock."

The Minister of Health, Catalina García, stated this Wednesday that her department has an "internal investigation" open into the case, while pointing out that we must "wait" until we know the court's decisions on the matter.

García has indicated that they are trying to clarify whether the girl died as a result of "a medical error" and, if so, activate the necessary mechanisms so that a similar situation "does not happen again."

The Ministry of Health will act "according to the sentence" handed down by the court and the result of its own "internal investigation," it has ruled.
