The Prosecutor's Office "does not oppose" that the former president of the Junta de Andalucía José Antonio Griñán not enter prison to serve the six-year sentence for the ERE case due to his serious illness, a decision that the Court has in last instance Province of Seville.

In a letter, the prosecutor heeds the advice of the forensic doctor who said that he has a "very serious and incurable" disease with incurable conditions, which is exactly what the Penal Code says in these cases to replace imprisonment with another form of execution of the sentence.

The Provincial Court of Seville had given a period of two days to the parties, after receiving the forensic report, to report on the conclusions of the doctor and thus make a decision on the future of the Andalusian socialist leader.

Griñán, 76, is the only one sentenced to prison for embezzlement and prevarication by the ERE who is still at large. The forensics conclude that, after the radiotherapy, Griñán continues with the hormonal treatment and that, in addition, he suffers from a whole range of side effects that are not being treated, without ruling out that other derivatives of the disease he is suffering from or of the treatments may appear. Therefore, they advise that he remain free to see the evolution of the therapy and its consequences.

The sentence, ratified by the Supreme Court, estimates that both Griñán and Manuel Chaves were responsible for the illegal public aid system that the Andalusian Junta established for a decade (2000-2009) to benefit companies in crisis.

The high court included in its ruling that Griñán had "awareness of the illegality" of the criteria followed with the ERE while highlighting his "passivity" in the face of the "waste and arbitrariness" with which the aid was granted.

Since the sentence was final, the socialist leader has taken all steps to avoid his entry into prison. On the one hand, he has alleged his illness, in addition to filing an amparo appeal before the Constitutional Court and a request for pardon from the Government.
