In September 2020, when the councilor of JxCat in Tiana (Maresme), Mateu Hernández, decides to make an altruistic donation to the town, which consists of audiovisual equipment, speakers and a projector, with the corresponding wiring, for the Albéniz room, where Most of the artistic and cultural activities of the town are carried out.
The set of equipment that Mateu Hernández gave away is valued at approximately 48,000 euros. After making the pertinent consultations with the municipal legal team, they determined that the donation was correct and that the wiring carried out, according to the report of the municipal architect of Tiana, is also correct, since not only does it not affect the artistic value of the room, but it increases it. .
The outrage came when the councilor, in 2021, was removed from his position by the then mayor of ERC, Marta Martorell, who also imposed an economic penalty on him, a decision that JxCat interprets as a cacique attitude of the mayor, since the donation is an important improvement for the municipal hall.
Referring the case to the Contentious-Administrative Court, the Prosecutor has disarmed the arguments provided by the previous City Council government team, both for the filing of the sanction and for the non-acceptance of the donation, and also criticizes that an act of generosity is paid with a sanction and removal from office, which he deems abusive, arbitrary and incompatible with the rule of law. Hence, the prosecutor's office itself requests the annulment of the sanctioning file.
