The PDECat bankruptcy proceedings concludes with a liability of 6.4 million euros

The commercial court number 8 of Barcelona has agreed to close the PDECat bankruptcy proceedings with a liability of 6,455,803.32 euros, after none of the creditors have requested the appointment of a bankruptcy administrator, as stated in an order at the beginning of December advanced by Europa Press, to which this medium has also had access.

It was a contest without mass, since the political organization did not have any property to face the situation of insolvency. The formation closed its doors on October 28 in an extraordinary assembly after the poor results in the general elections on July 23.

Of the 6.45 million euros liabilities of the PDECat, 6.3 correspond to the economic forecast that the law required the heir party of Convergència Democràtica de Catalunya (CDC) to have while being prosecuted in the case of 3% of the Court National, which is still pending trial, according to sources consulted.

On the other hand, of the remaining 150,000 euros, 130,000 correspond to old suppliers and 20,000 are expenses from the Employment Regulation File (ERE) that existed in the PDECat. The sources consulted point out that the PDECat has met most of its own obligations and those that came from the CDC and that everything related to Social Security, Treasury and other obligations has been paid.

In parallel, in the commercial court number 9 of Barcelona the bankruptcy of CDC is still open, which unlike the PDECat did have several property offices that were initially seized in the courts due to the Palau case.

In the Palau case ruling, final since 2020, CDC was sentenced to return 6.6 million euros from the looting of the Palau de la Música. In any case, creditors have priority when collecting, before the obligations derived from the judgment. It will be the commercial court that determines whether the PDECat is the legal successor of Convergència after the special jurisdiction conflict chamber of the Supreme Court resolved a conflict of jurisdiction in favor of the commercial court 9 of Barcelona and to the detriment of the Barcelona Court.

For all these reasons, in February of last year, the Barcelona Court declared itself not competent to find out who the successors of CDC are for the purposes of the Palau case ruling and the piece was archived. The Palau de la Música had asked that Junts and PDECat face the sentence.
