The man who stabbed his ex-partner and his daughter to death in Carabanchel was acquitted of abuse

Early this Monday, the National Police arrested a 26-year-old man as the alleged perpetrator of the stabbing murder of Tatiana Beatriz, 25, and Abril, their five-year-old daughter, in the Madrid neighborhood of Carabanchel. The man was found in serious condition with a wound to the neck in the same home where the girl's body was found, since apparently he tried to commit suicide with the knife with which he would have committed the double crime. The young woman's body was found in the parking lot. Apparently, he killed her first and then went up to the floor where the girl was.

If the sexist nature of the crime is confirmed, Tatiana Beatriz would be the 53rd victim so far this year (after another crime on Saturday) and Abril the second of vicarious violence in 2023.

The case is especially hard since the young woman was registered in the VioGén police system after reporting her partner. The Police classified this case as high risk, which is why she had very high protection measures. But the violence against women court number 4 of Madrid withdrew on October 30, 2020 the protection measures imposed a month and a half earlier by another court on the murdered woman.

In this sense, sources from the Superior Court of Justice of Madrid detailed that the protection was ordered on September 15, 2020 by a court in Torrejón de Ardoz (Madrid) following the complaint filed by the victim for the attack committed by her alleged murderer. on the 6th of that month and another in the month of July.

But when the court specializing in violence against women studied the case, it decided that there were “no indications that in the month of July and in an argument without witnesses, the person under investigation attacked the complainant, and there was also no injury noted in the report. of assistance of such alleged fact.”

Nor did he find evidence of “simultaneous threats with knives” on September 6, so he denied the protection order because “the objective situation of risk required by law did not exist” as it was “an isolated incident” and because the woman , “following the advice of his father, who lived with them,” he did not report at first.

She did it a week later and, as she explained in the sexist violence court in Madrid and stated in the record, “it was not for her protection, but to try to prevent the person under investigation from taking her daughter to Peru, because in those days “She became aware of his intention to return to his country and feared that he might take the girl.”

Once the protective measures were lifted, the criminal procedure continued and the man was acquitted in December 2022 in the trial for injuries and abuse in the family as there was no evidence to substantiate the accusation.

The criminal court number 37 of Madrid issued the acquittal sentence given that during the trial the complainant said she did not remember what happened, there were no witnesses to prove the attack and the police officer who arrested the accused explained that he only told her that they had argued.

And there it was all. This Monday, this 25-year-old girl and her little girl savagely lost their lives.
