In her brief, the judge ratifies the provisional detention situation for the former Brazilian soccer player and agrees to impose a bail of 150,000 euros to cover eventual compensation to the victim, with the warning that if he does not pay it within 24 hours, he will proceed to seize your assets in the amount sufficient to cover it.

Alves has spent half a year in provisional prison, after being arrested by the Mossos d'Esquadra for allegedly raping a 23-year-old girl in the bathroom of a private room at the Sutton nightclub in Barcelona on the night of December 30.

As detailed by the judge in her order, due to the sexual assault, the victim suffers a "globally high" intensity post-traumatic stress disorder.

In her letter, the magistrate maintains that, from the proceedings carried out in the investigation, there are "sufficient rational indications" to "assume" that Alves was dancing with the victim and that the former soccer player, on two occasions, took his hand and held it He put it on his penis, whereupon the girl withdrew it both times.

Subsequently, from the door that led to a small bathroom for the exclusive use of the VIP area, Alves called the girl and, when the young woman came, he pulled her forcefully, to which the victim told him to stop, to let her go. let him out and that he wanted to leave.

Despite this, according to the judge, Alves ignored her, pulled up her dress, made her sit on it, grabbed the back of her head and threw it to the ground - which caused the girl a wound on her head. knee-, to try to get him to perform fellatio, although he failed, which "enraged" the footballer.

Faced with this situation, according to the magistrate, the former Brazilian international hit the victim "several slaps" on the face, put her on her back against the small sink, rubbed his penis against her body and finally penetrated her "violently."

After finishing the rape, according to the judge, the girl wanted to leave the bathroom, although Alves did not allow it, so the former soccer player came out first and then she. When the girl finally managed to get out of it, she came to a table where her cousin was, who saw her with a "very bad face", at which time she told him what had happened, according to her car.

According to the judge, since he left the bathroom, Alves did not address the victim again at any time and when the former soccer player left the club with a friend and ran into the young woman, he did not speak to her.

During the investigation of the case, the former FC Barcelona player has offered up to four different versions of what happened in the bathroom of the nightclub.

After his arrest, last January, he initially maintained that he did not know the victim, then admitted that he met the young woman in the nightclub's bathroom without anything happening between them and finally, when the judge compared his explanations with the evidence Biological tests, he maintained that the girl had performed fellatio on him, consensually.

Last April, when the results of the biological tests that found traces of Alves' semen in the victim's private parts were already known, the footballer returned to testify before the instructor at his own request.

In that appearance, he admitted for the first time that he had had consensual sexual intercourse with the victim vaginally, and argued that on the first occasion he had lied to hide his infidelity from his wife.

The ups and downs in his account of the events, in the face of the "persistence" shown by the victim in his statements, is one of the arguments that the court has used to reject his provisional release, as his defense has unsuccessfully requested on several occasions. occasions both to the examining magistrate and to the Court of Barcelona.
