The impossible digestion of the amnesty

An ordeal awaits the unborn amnesty, if it sees the light. On the street for a while. And in institutions indefinitely. An earthquake replaces one landscape with another, only in a traumatic way. And a law of criminal oblivion, underpinned by the arithmetic necessity of an investiture, is one. So few surprises. And much less that ultra idiocy, which shares 99.9% of its genome with the rest of the idiocies of another sign, takes over the Madrid night thanks to its skillful handling of verbal and factual violence. When the lamp of speeches is rubbed, the most base fanaticism always appears alongside the genius, regardless of the cause.

Feijóo and his people take note of the need to draw an impassable line between ultra imbecility and legitimate protest against what the Spanish democratic right, and part of the silent left as well, considers an outrage. And that line, of course, is not drawn with tenuous and ambiguous condemnations. Not of course accusing Pedro Sánchez of being to blame for everything, as Elías Bendodo, the general coordinator of the PP, stated yesterday. Esperanza Aguirre blocking traffic is the grandmother preparing sandwiches for her grandson in a balaclava. Ayuso, lighter in one hand, fire extinguisher in the other, has been better at pointing out the need to arrest and judge the criminal. This section is not intended to be a self-help manual, but we do not resist good advice: in the call next Sunday against the amnesty in all the capitals of Spain, the PP would do well to have an army of volunteers ready to throw out kick any clown seasoned with ultra symbology. Although it is true that since the protest is at noon, the risk that the unintelligent and highly tattooed gossips will take over the call is lower. At that hour, the midday light scares cowards. And the gullets, lungs and noses of the stupid squad have not yet consumed enough product to become completely animalized. Even so, as has been said, the right must monitor its right flank to remain on the playing field of what is normal and legitimate: being radically against something and demonstrating it democratically.

However, the main problem of the amnesty will not be the streets. The future law, if it becomes corporeal, faces more serious threats that at this point are already known to be inevitable. The first is equivalent to what, referring to a product, would be equivalent to a manufacturing defect. The logic of his negotiation – amnesty in exchange for investiture – is indigestible for a not inconsiderable part of Spanish society and makes the creature a defective being. If we add to this the stretching of the negotiation in recent days, with causes and proper names that now, now, no, enter the beneficiaries' raffle, the sensation of exchange, which was already the starting point, does not stop. to increase and worsen. It started badly and it won't end well. The amnesty, like the pardons, had to arise from the legislative impulse of the executive with the new mandate already underway, even if it had been previously agreed as an objective. That is the primordial stain that will prevent, unlike what happened with the pardons, a minimum of hidden indifference and laissez faire among its opponents. Without that minimum concession, what remains is half of Spain amnestying half of Catalonia. Back to the halves.

The other threat responds, as so often in football, to trying to win in the offices what has not been won on the field. In the last decade we have already seen enough examples of how justice – some of it, we should clarify – cannot escape the temptation to overreach to remedy what was agreed in the field of politics. Of course the legislature, when the ball rolls, must also submit to the law. But there are already too many times in which judges, either due to affinity or contracted debt, or due to the inability to abstract themselves from the ideological servitudes of one's own self, have confused their formal independence with a tipex and a pen. The first to delete and the second to rewrite and reformat the story to your liking. *This time it will not be different either.
