The Government sanctions Just Eat for illegal assignment of workers

New blow from the Labor Inspection to home delivery companies. In this case, it has been Just Eat who is accused of illegal assignment of workers.

The Government of the Generalitat has imposed a fine of 187,515 euros for illegal assignment of workers as a result of the proposal of the sanction in the minutes drawn up by the Labor Inspection of Catalonia (ITC), notified on April 1, 2022 The infraction is classified as "very serious due to the violation of the labor relations regulations".

As the fine exceeds 150,000 euros, it must be validated by the Consell Executiu, which was done this morning. The act drawn up by the ITC also proposed to sanction the subcontracting company Fleet Delivery Solutions, which supplied illegal labor to Just Eat, with 62.5O3 euros.

As a result of the aforementioned illegal transfer, 183 workers of the company Fleet Delivery Solutions SL were harmed, since a lower collective agreement was applied to them than the one that would correspond to them if they were hired directly by Just Eat, explained the Government of the Generalitat .

The damages suffered by the workers were specified, among others, in lower economic remuneration, because Fleet Delivery Solutions applied the State Agreement of Courier Companies while Just Eat applied the Agreement of Offices and Dispatches of Catalonia for employees.

The Just Eat sanction comes despite the fact that the company is one of the few in the sector that uses contract workers instead of freelancers like other platforms.

Sources from the Dutch multinational assure that they have not yet received the official communication of the sanction and assure that when the time comes, they will appeal the decision before the judicial authorities. In April, they already presented allegations that finally did not bear fruit.
