A man sentenced to four years in prison for domestic violence and gender violence registered in the Civil Registry as a woman to try to avoid prison, according to two of his victims, who consider that this individual could be committing fraud.

The lawyer of the attacked women, María José Atoche, was in charge of communicating to them the change made in the month of July by Antonio Luis B.R. under the protection of the Law for the Real and Effective Equality of Trans People and Guarantee of LGTBI Rights, according to the newspaper ABC, a modification carried out “without any prior study that proves that it feels that way”, in addition to informing them that Her abuser has submitted a request for clemency to the central government, alleging that “she considers herself a new person as a woman and has understood the damage she has done.”

The two women met after putting an end to the relationship that united them with this individual. Patricia, the last of his partners, had suffered both psychological and physical violence from Antonio Luis and discovered that his previous girlfriend had also suffered the same violent episodes. They both contacted him and, as a result, decided to file a complaint against this man.

It was in July 2019 when the Criminal Court number seven of Seville convicted him of domestic and gender violence, habitual abuse, a crime of domestic and gender violence, injuries and abuse; a crime of domestic and gender violence and coercion and a crime of breach of precautionary measure, with the incomplete defense of anomaly or psychological alteration.

Already in March 2022, the Criminal Court number two also sentenced him to four years in prison and various fines for a crime of habitual physical and mental abuse with the mitigating circumstance of mental alteration, six crimes of physical abuse, a crime of coercion in the family environment, a crime of damage, a minor crime of damage and a further crime of breach of precautionary measure.

Subsequently, in October 2022, the Fourth Section of the Seville Court partially upheld his appeal against the latest conviction, reducing his prison sentences to three years and four months.

Now, four years after receiving a first conviction, according to this lawyer, the man is trying to take advantage of the twists and turns of a law that is not designed for this purpose, which has caused the “indignation” of the victims who maintain that “in no way moment has given indications that he feels that way", but on the contrary, he is a "homophobic and sexist" person. "It is incongruous to say that he feels like a woman. "He doesn't regret anything and he does it as the last cartridge to try to avoid prison," the two women said, considering the turn taken by the case to be "surreal."

He is not “a simple abuser,” comments one of the women who suffered sexist violence from the convicted man, but rather he is “a full-fledged psychopath” who will continue to act in the same way if he receives a pardon: it would mean giving him "carte blanche" to commit a crime in the same terms for which he has been convicted, he noted. The fear of this happening is once again on the heels of both victims, just now when, after years of judicial proceedings, he was going to go to jail.

For her part, the lawyer for both complainants has warned that the man could be committing “clear fraud” given his “tortious use of a legal norm.”

One of the women who reported abuse against the man has explained that, after about “five months of relationship” with him, she began to impose “prohibitions and restrictions” on him, which later led to “threats and verbal and physical attacks in all possible ways.” ", even "beatings", because "he didn't want her to see any of the boys" of her friends, according to the victim's story to ABC.

The other ex-partner focuses on the violent and controlling character of Antonio Luis, and explains that he suffered "from grabbing me to having me locked in his apartment for four hours on my knees while he injured himself," he detailed, pointing out the "panic" he felt and that The convicted man spent "eight months in preventive detention" for failing to comply with a restraining order that had been imposed on her.
