The judge of the National Court Santiago Pedraz has issued an order in which he agrees, prior to the temporary suspension of the resources associated with Telegram, to request a report on the social network from the General Information Commissariat of the National Police.
The magistrate requests information about its characteristics as well as the impact that the temporary suspension that he agreed to in his order last Friday may have on users and whose execution is suspended, according to the ruling.
The judge of the National Court Santiago Pedraz had ordered last Friday night to provisionally suspend the Telegram instant messaging application following a complaint filed by Mediaset, Atresmedia and Movistar Plus for alleged unauthorized use of copyrighted audiovisual content. .
Given the lack of cooperation from Telegram after repeated requests to cease its activity in the country, the judge ordered the operators - Vodafone, Orange, Digi, Movistar, MásMóvil and others - to suspend the resources associated with the application within a maximum period of three hours after receiving communication of this order. However, on Monday morning he issued an order suspending the execution until he had the police report in his hands.
The head of the Central Court of Instruction number 5 adopted the decision within the framework of a request for a precautionary measure requested by the audiovisual companies so that the activity of the messaging application could be paralyzed while the investigation is carried out.
The investigating magistrate considers this measure as "necessary, suitable and proportional" for which "there is no alternative that could stop the repetition of the reported events", since Telegram has not collaborated or reported certain technical data that would allow the identification of the perpetrators. holders of the accounts used for the infringement of intellectual property rights, the order stated.
