Can products with CBS be sold in vending machines?

The All Day CBD company, which belongs to the Equipo Unico group, has ceased its work activity in Spain about ten days ago, after being intervened by the police, for selling drugs in its vending machines. The company maintains that it markets CBS.

On the contrary, the Tax Agency, which has carried out the investigation from its customs division, together with the local police in Madrid, argues that said company sold marijuana buds, in packets similar to those of tobacco. I mean, drug. The controversy is served. And prosecuted the case.

In total, they had placed between 30 and 40 vending machines in bazaars in the center of Madrid. And about 10 people worked in the company.

On its official page, the company has released a statement specifying that "we do not sell marijuana in our machines, we sell CBD, a 100% legal substance." To which they add: "We have decided to provisionally suspend our activity pending a judicial decision that rules and protects the legality of our activity."

In reality, the company has been forced to close the door because it has been intervened and the local police have sealed all its machines. In addition, in principle, tobacco vending machines have a kind of license plate and are controlled by the Tobacco Market Commissioner. This company, in principle, recycled vending machines and put them in places to sell their products.

In Spain, the sale of CBD is regulated. In principle, it can be legally marketed in physical establishments, online stores and tobacconists. This substance can only be legally marketed for external use. In other words, the sale of creams, lotions and oils made from cannabidiol is completely legal. The CBD-based product must not contain more than 0.2% THC. Of course, it is not legal to market CBD in food format.

The legal sale of CBD is different in each country. In the United States the sale, use and consumption is legal, although some states limit its commercialization. In Finland it is necessary to have a prescription to acquire and carry CBD for medicinal and therapeutic use, as it is considered a medicine. While in France, Denmark and Bulgaria the sale of cannabidiol is legal as long as it does not exceed a THC concentration of 0.2%.

In Spain, in addition, there are Supreme Court rulings, which state that in the case of hashish, like the rest of cannabis derivatives, the percentage of the active ingredient, tetrahydrocannibol (THC) does not indicate that only that percentage is hashish and the rest Coming from mixing or adulteration, it is entirely hashish, regardless of the percentage of THC, which only determines its potency. It is different in other drugs, such as heroin or cocaine, which are obtained through chemical processes.

The question that the All day CBD company will have to answer in court is how they lower the amount of tetrahydrocannibol. Be that as it may, for now the business cannot continue until the situation is clarified. A company spokesperson, who remains anonymous, has told the World that "we only buy certified products, with a THC of 0.2%, as well as reputable products with certified facilities." He even "has been accused of selling marijuana to children, when the machines have to be activated by the owner of the premises," he says.
