Auction of flats and properties of the Agència Tributària: how much do they cost and where are they located?

The Catalan Tax Agency (ATC) resumes the electronic auction of assets seized for outstanding debts. A measure that started in mid-2019 but was challenged by the Government that October due to a clash of powers. Finally, in January 2022, the Superior Court of Justice of Catalonia (TSJC) recognized the competence to call auctions, but through the Official State Gazette (BOE) portal.

"The ATC completes the process of comprehensive assumption of all phases of executive collection of debts and is provided with a key tool in the management of taxes, which allows the recovery of uncollected income in a voluntary term in an agile and transparent manner ", it is noted in a note published this Wednesday by the ATC in which it announces the reactivation of the processes.

Auctions are an alternative with more and more pull to get discounted homes, but it must be taken into account that they may be occupied and not recorded as such, that they are in poor condition since they cannot be visited, that they carry hidden charges in taxes or that the price is not always accompanied by an appraisal that is excessive, above the market, when taking into account values ​​such as the reference.

To all this we must add that the obligation of a 5% deposit requires having savings to participate.

The goods up for auction can be consulted at the ATC headquarters. At the moment there are three houses, two buildings, two premises and two plots. The first auction will take place in September, as calculated by the Tax Agency.

In the houses, one is a mezzanine on Rambla de Badal in Barcelona. It has 89 m², with a starting figure of 278,660 euros. The division does not appear or if it is rented or occupied.

The other two houses are in Caldes de Montbui, in the same building. They are the ground floor (133,665 euros, 75 m², three rooms) and the first floor (136,752 euros, 75 m² and three rooms).

A building in Castelldefels with three floors for parking would also be auctioned with a starting price of 1.3 million and previous charges of 850,600 euros. It consists of 2,700 m².

In addition, another building in Terrassa is auctioned for 700,426 euros, with five homes and a store.

As for the premises, one is in l'Hospitalet de Llobregat, measuring 53 m². The local, with a sink, occupies 15 m² and has an adjoining house of 38 m² with a kitchen-living room, a bedroom and a bathroom. 76,022.45 euros of output are requested. The other is in Barcelona, ​​in the El Coll neighborhood, measuring 105 m² and two floors. The starting price is 66,548 euros.

To all this are added two plots, one in Caldes de Montbui of 239 m² for 136,752 euros and another in Sort of 271 m², in polygon 2 of the Borda del Paisan for 371,259 euros.

Those who are interested in participating have to do so through the BOE auction page, where a deposit of 5% of the goods of interest must be made. This means that you have to have savings to qualify for auctions. For example, for the building in Castelldefels you have to deposit 65,087 euros, about 35,000 euros for the one in Terrassa, for the Sort site about 18,500, for the house in Barcelona about 14,000... The lowest figures are given for the premises, between 3,300 and 3,800 euros.

Once the deposit has been validated, you have 20 calendar days to make bids. If someone bids more, you will receive an alert in case you want to raise the number.

If an auction is won, after the lots have been awarded, you have 15 days to complete the purchase price, minus the advance deposit.

Before an asset is adjudicated, the debtor, whose property is auctioned, can cover the debt and release the asset from the auction.

The portal presented now is similar to the one that the Spanish Tax Agency has, in which houses, garages, premises and plots are collected at auction throughout the country.
