The lawyer, furthermore, did not personally attend the statement that Aragonès gave before the investigating judge to ratify his complaint for the attack with Pegasus and "was replaced" in that appearance by another judicial secretary.

But what made Aragonès' lawyers interested in her identity were "two serious irregularities in the management of the file" related to her responsibilities as a lawyer for the administration of justice in the Pegasus case.

One of these irregularities, Van den Eynde details, consisted of the "disappearance" of a computer expert report on the scope of espionage with Pegasus that the lawyer did not locate until almost a year after it was lost, following a complaint filed by Aragonès himself.

According to the lawyer, this is a circumstance "not only unusual but also demonstrates poor management of the custody of the judicial file with an absolutely negative impact on the interests of the victim."

The letter also reasons that Montserrat Del Toro "has demonstrated in a more than public way her personal position contrary to the interests and political options" defended by Pere Aragonès, which is why it considers that she should refrain from participating in the proceedings related to the espionage investigation. with Pegasus.

Specifically, the lawyer recalls that Del Toro was a protected witness in the procés trial, so he believes that it cannot be denied that he has "animosity and negative predisposition" towards Aragonès, who "is not only a defender of the innocence of those were condemned at the time" but also the "main political leader defending the ideas and objectives of the independence cause."
