Suspended due to the justice strike, the trial against Baltar for going 215 km per hour

The Zamora Criminal Court has suspended the trial scheduled for this Wednesday against the acting president of the Orense Provincial Council, José Manuel Baltar, accused of a crime against road safety, due to the strike by workers of the Administration of Justice. for driving at 215 kilometers per hour on the A-52 highway, the Superior Court of Justice of Castilla y León has reported.

This is the third suspension of the trial against Baltar for a crime against road safety, since previously the previous speedy trial was postponed twice, on one due to the non-appearance of the lawyer and the other because the defendant did not agree with the request for prosecution penalties.

The oral hearing, scheduled for ten in the morning, has been postponed to a new date that has not yet been determined, in which the speeding that a speeding radar registered after half past six in the afternoon on Sunday, April 23, must be judged. traffic temporarily installed at a fixed point at kilometer 67 of the A-52, near Asturianos (Zamora).

In any case, Baltar's lawyer in statements to the media has defended that there is no crime against road safety because the facts previously led to an administrative sanction that invalidates the criminal actions. The lawyer Juan Ramón Montero has once again defended this Wednesday that "there is no room for criminal proceedings" and has declared that it is a "legally resolved and already sanctioned" issue, something that he will also raise in the considerations prior to the trial, to for which there is still no new date of celebration.

Baltar's lawyer refers to the six points of withdrawal of the driving license and the fine of 600 euros that were reduced to 300 for prompt payment, which were notified to the president of the Provincial Council of Ourense when he was stopped for speeding , since the agents could not determine at that moment if the speed at which he was circulating could be considered a crime or only an administrative sanction.

The Prosecutor's Office has requested in its indictment a penalty of six months of fine at a rate of ten euros a day, which adds up to a total of 1,800 euros, and one year of withdrawal of the driving license for a crime against road safety.

Since Baltar was not satisfied with the proposal of the Public Prosecutor's Office, the oral hearing was held in the Criminal Court of Zamora and not through a speedy trial in the investigating court of Puebla de Sanabria.

It so happened that that same day, about an hour earlier, another radar detected the official car of the president of the Orense Provincial Council circulating on that same highway at 173 kilometers an hour at the height of Allariz (Orense), which implies another administrative sanction.

To record the strike that has forced the trial to be suspended this time, Justice officials have demonstrated at the gates of the Palacio de los Momos, headquarters of the Zamora courts, with shouts of "without us there is no Justice" and "These socialists are fascists."
