The Traffic Division of the Civil Guard of Palencia is investigating a driver who was driving on the A-62 highway (Burgos-Portugal) on April 16 without a rear tire and under the influence of alcohol and drugs. The man was denounced for this reason twice in the same day. The first of these took place when he was traveling irregularly on said road. The car, which was without one wheel, moved constantly invading the left lane, as well as the shoulders on both sides.

The agents intercepted the vehicle at kilometer 78 of the A-62 towards Burgos. There they performed the breathalyzer and drug test on the driver, who tested positive for both. For this reason, they proceeded to remove his car and opened an investigation for a crime against Road Safety.

A towing service was in charge of taking the car and the offender, who stole his own vehicle once it was unloaded from the platform. Hence, he was arrested again hours later, after the Civil Guard was alerted to what happened at the assistance service base. According to the meritorious report, when the car had been lowered from the tow truck and the operator was taking steps to provide him with a taxi, the driver got back inside and fled.

After receiving the notice, the patrols proceeded to search for the car, which was located at kilometer 92 of the A-62, in the direction of Portugal, and was finally intercepted four kilometers later, at kilometer 96 of the same road.

The agents carried out the breathalyzer tests and the detection of drugs and narcotics again. The result was positive for alcohol, cocaine, THC and amphetamines, for which reason an investigation was opened against the driver for crimes against Road Safety.

It should be remembered that the Criminal Code establishes the following penalties for driving with excess alcohol (more than 0.60 mg/l) or under the influence of drugs: imprisonment of three to six months or a fine of six to twelve months or work for the benefit of of the community from 30 to 90 days, and deprivation of the right to drive from one to four years.

With regard to reckless driving, article 380 of the Penal Code establishes that whoever drives a motor vehicle or a moped recklessly and consequently endangers the lives of others will have their permit withdrawn from 1 to 6 years and faces prison for 6 months to 2 years.

If this conduct is also carried out with "manifest disregard for the lives of others", the punishment will entail a prison sentence of two to five years, a fine of twelve to twenty-four months and the deprivation of the right to drive motor vehicles and mopeds. for a period of six to ten years.
