A 23-year-old young man has been sentenced by the Court of Alicante to two years in prison for sexually abusing a minor under 16 years of age and instigating her to send him photographs showing herself naked.
The sentence, handed down by a Second Section court, states that the abuses occurred during the month of August 2020, when the defendant and the victim, who was 14 years old at the time, were bathing on the Levante beach in Benidorm. .
The text states that both had established contact by going to the same water ski center and details that, on one occasion, when the two were in the water, the defendant approached the minor in an area where she had no footing. to pick her up, kiss her and touch her breasts and genitals "outside and inside her clothes" against her will.
Finally, the girl was able to return to the shore and get away from the accused, but, in addition, the specific sentence that in October, the accused sent a WhatsApp to the minor in which he told the victim: "I want to see your tits." He also asked her to send him photographs in which she showed herself naked, "at least from the neck down", to which the minor did not agree.
The defendant acknowledged sending the messages during the trial, on February 21, although he denied the touching against the girl's will to maintain that it was the minor who kissed him, who touched his penis and who put his hand on her breasts.
In addition, he said he was unaware that the girl was a minor and that, in fact, she had told him that she was over 17 years old. However, the court confers credibility on the victim's account, who declared that she did not get any older than she was.
The sentence imposes on the defendant a sentence of one year and six months in prison for a crime of sexual abuse of a child under 16 years of age, to which is added the measure of probation for three years. And he imposes another six months of internment for a crime of corruption of minors for inciting the girl to send him the photographs of her and adds another two years of probation in relation to that second crime. Finally, it establishes that the convicted person must compensate the minor with 2,000 euros for the moral damages caused.
