The judge handling the case of an alleged sexual assault committed on June 22 against a minor under 13 years of age by a 23-year-old adult in the Màgic Badalona shopping center has filed the case on the understanding that it was a consensual relationship in which the alleged aggressor did not know the age of the minor.
The man who was arrested by the security guards of the shopping center, according to RTVE, has been released without charges. The allegedly assaulted minor admitted that he accessed a dating social network in search of sex, without disclosing his real age. Even so, the Mossos arrested him when the security guards discovered that the minor was giving him fellatio in the parking lot.
As La Vanguardia reported, the minor actively sought a sexual partner near his area of residence, an extreme that the judge has taken into account so as not to proceed against the adult. Both were to have a coffee and get to know each other, and then go to the parking lot to have consensual sex. Sources of the investigation have assured that the minor appears to be over 13 years old, so the alleged aggressor could have been deceived, as has been proven.
The mayor of Badalona himself, Xavier Garcia Albiol, at the time already separated this case from the other forced attacks that have occurred inside the shopping center. Despite the fact that the judge dismissed that the City Council could appear in the case as an accusation, the mayor has already advanced that it was a case of consensual relations.
