The Fourth Section of the Litigation-Administrative Chamber of the TSJCV has dismissed the appeal filed by the association Lo Rat Penat against the decision of January 31, 2020 of the Valencian Language Academy (AVL) to approve a cooperation agreement with the Filological Section of the Institute of Catalan Studies, IEC, and the Universidad de Baleares for inclusive and unitary linguistic regulations.

The Fourth Section of the Litigation-Administrative Chamber of the TSJCV has dismissed the appeal filed by the association Lo Rat Penat against the decision of January 31, 2020 of the Valencian Language Academy (AVL) to approve a cooperation agreement with the Filological Section of the Institute of Catalan Studies, IEC, and the Universidad de Baleares for inclusive and unitary linguistic regulations.

Contrary to what was alleged by the appellant, the Court understands that there was no formal violation in the convening of the AVL Plenary Session in which this agreement was adopted.

On the other hand, the Chamber points out that the signed agreement does not have a normative nature, but rather is "a general protocol of action that involves a mere declaration of intentions of general content", so an opinion from the Consell is not mandatory. Legal Consulting.

For the same reason, according to the magistrates, the agreement does not imply a transfer of powers to a body other than the AVL, nor does it violate the legislation that regulates this institution nor does it contravene the Statute of Autonomy of the Valencian Community. The sentence is not final and can be appealed in cassation before the Third Chamber of the Supreme Court.
