The Mossos d'Esquadra arrested yesterday in Bisbal d'Empordà the man who allegedly raped months ago the mother of the baby who was found dead on January 2 in a trash can on a central street in the capital of Baix Empordà.
The mother of the little boy, about twenty years old, who was located a few days ago, explained to investigators that the pregnancy was the result of a rape and that the child was already born dead. Following the details given by the victim about the alleged aggressor, the Mossos arrested him yesterday and this morning he was brought to justice as the alleged perpetrator of a sexual assault.
According to the Superior Court of Justice of Catalonia (TSJC), the judge, since none of the parties has requested any precautionary measure, has agreed to release him. He has also released her mother, who has also been brought before the court today as being investigated for the child's death, without precautionary measures.
The Mossos d'Esquadra identified her as the person responsible for depositing the newborn, now dead, in the trash can. The judge has agreed to several procedures, pending completion, to determine what happened. The case remains open.
The events emerged last week when a garbage collector found the lifeless baby in a trash can on the central Germans Sitjar street, located behind the church. The little one, who still had the umbilical cord, was inside a plastic bag.
The child's mother, of African origin, would have hidden the pregnancy from her family environment. The woman told investigators that the child was born dead, a fact that would be confirmed by the first preliminary results of the autopsy performed on the baby.
