The Third Section of the Provincial Court of Alicante has sentenced a man who sexually abused a minor cousin and took sexual photographs of a sister of that victim, also a minor, to nine years in prison, images that he later distributed. on a website with pedophile content.
The Chamber considers him the author of a crime of distribution of child pornography relating to a person under 13 years of age and of a continuing crime of sexual abuse committed with respect to the second of the girls.
In both cases the Court appreciates the mitigation of undue delays. The sentence absolves him, however, because it is not considered proven, of another crime of sexual abuse regarding the minor of whom he took images.
The man must compensate one of the victims with 10,000 euros and the other with 5,000 and will not be able to communicate with the minors or come within 500 meters of them, their school, home and other places where they carry out their usual activity for a period of time. time of 10 years.
The events began in 2014, when the first of the victims was between four and five years old and the convicted man took advantage of the relationship of trust that she had, as she was his cousin, and with the girl's mother, who in addition to her aunt was his godmother, to take several photographs of lewd content.
The convicted man, who was taking care of the girl while the mother worked, took the photos in May 2015 at his parents' house, in a municipality in the Vinalopó Mitjà region, or in a craft store in a town in the same area. region, which belonged to his in-laws. The images were detected in March 2017 on a website with pedophile content located on the TOR Internet network.
The ruling maintains that, prior to these events, between 2011 and 2012, the man subjected the first victim's sister to her genitals, when she was between 8 and 9 years old. According to forensic reports, the girl suffers from anxiety and other symptoms related to a feeling of guilt for not having told her previous experiences, which could have protected her sister.
The sentence is not final and can be appealed to the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community.
