Ayuso will urgently modify the trans and LGTBI laws of Madrid

The parliamentary group of the PP in the Madrid Assembly, headed by President Isabel Díaz Ayuso, registered this Friday, in the middle of a festive long weekend in the capital, and for urgent processing, the modification of the law on identity and expression of gender and comprehensive protection against LGTBIphobia. A movement that Más Madrid calls "legislative setback."

The absolute majority of the popular formation in the regional Chamber allows Ayuso to accelerate his action schedule to fulfill his electoral commitment that both laws be modified before the end of 2023. "I have stated for a long time that "I am against how the trans law is written in Madrid and I am in favor of repealing the most pernicious aspects," the Madrid leader has repeated on several occasions.

This modification seeks to "provide greater clarity and legal certainty" and eliminate some aspects in force in both the trans and LGTBI law of Madrid such as "the reversal of the burden of proof", which forces the accused of discriminating against trans people to prove their innocence.

Among others, the PP intends to "correct some aspects, whether in good faith or motivated by the desire to impose certain doctrines known as gender, which ended up violating rights such as freedom of expression and of the press, and academic and educational freedom." of articles 20 and 27 of the Spanish Constitution, or the presumption of innocence of article 24 of the Constitution".

The municipal councilor, and former regional deputy, of Más Madrid Eduardo Rubiño describes the PP movement as the "first legislative setback in this matter in the history of democracy."

The modification of the law is, however, an intermediate step to the latest plans outlined by Ayuso. The regional president, in fact, hinted last March - on the eve of the elections - of her willingness to repeal it.

The current regional Law on Gender Identity and Expression and Social Equality and Non-Discrimination was approved in 2016 by the government chaired by Cristina Cifuentes thanks to external support from Ciudadanos.

Despite the condensed parliamentary calendar between now and the end of the year, partly due to budget processing, both bills will be approved by the emergency procedure, allowing time in the Chamber of Vallecas to be significantly shortened.

The PP's parliamentary initiative does not end there given that the Bill registered by its spokesperson in the Assembly, Carlos García-Pache, seeks to modify fifteen legislative texts in the Community, including the Land Law, the Chamber of Accounts Law or that of Radio Television Madrid.

Specifically, the PP has registered a Proposal for a Law on Measures for the Simplification and Improvement of the Efficiency of Institutions and Organizations of the Community of Madrid with which it intends to "continue advancing in the line of clarity and regulatory simplification of the Community of Madrid ".

In this sense, it proposes a law that includes an expository part, ten articles, five additional provisions, a transitional provision, a repealing provision and six final provisions to introduce modifications that affect a total of fifteen legislative texts that regulate fundamental institutions and bodies.

According to the PP, the aim is to "provide them with greater agility and efficiency or to overcome situations of blockage in their actions", as well as homologation with state legislation, "at the same time as updating the regional regulations that, according to experience, have demonstrated the need for its reform".

The modifications affect regulations such as the Government and Administration Law, the Chamber of Accounts Law, the Law of the Official Chamber of Commerce, Industry and Services of Madrid, the Law of Suppression of the Advisory Council, the Madrid Radio Television Law, the Law of Good Governance and Professionalization of the management of health centers and organizations of the Madrid Health Service (Sermas).

Likewise, it modifies the Law of Transparency and Participation of the Community of Madrid, the Law of Urgent Measures for the promotion of economic activity and the modernization of the Administration of the Community, the Law of Cooperatives, the Law of creation of the integrated system of Civil Protection and Emergencies, the Land Law, the Law of Consumer Protection, Forestry or Nature Protection, Livestock Routes.
