The victim of an alleged rape on a boat trip between Alicante and the island of Tabarca has accused the only defendant of pouring an inhibitory substance into his drink to commit the sexual assault.

“She must have put something in my drink, otherwise I wouldn't have slept with anyone without using a condom” since she is very aware that a friend of hers contracted HIV in an unprotected sexual relationship and, therefore, she would never have sex knowingly without a condom, he stated this Wednesday before the court of the Third Section of the Alicante Court during the trial.

In her statement, the victim indicated that, throughout that afternoon, the accused had served her wine on some occasions and that, at one point, he pointed out which glass was hers, to correct her regarding the one she intended to take. .

The woman has maintained that she was not able to remember anything that happened on that trip between the late afternoon of the day of the events and the following morning, and that she only began to recover partial memories hours later, after having reflected and talked. with the rest of the companions who remained on the boat.

“I was unconscious, I felt very cold and I was very sleepy; I only remember that I woke up because someone was penetrating me, although I couldn't move and I fell asleep again,” she explained when asked by the prosecutor and his lawyer, who is prosecuting the private prosecution.

She has maintained that she did not feel any physical attraction for the accused and that she had not flirted with him at any time during the moments prior to the alleged sexual assault, while at the same time she has said that all the people on the boat had consumed alcohol, although she did not agree. He was intoxicated and did not consume drugs.

“I woke up the next morning and saw that he was touching my boob; I asked her what had happened and she told me that we had gone to bed," he explained in reference to the accused before adding that "at that moment I didn't remember anything, I went to the bathroom and started crying."

The victim has stated that when she woke up “she was dressed and even had her bra on: It is impossible for a person who wants to sleep with someone of their own free will to get dressed again and continue sleeping with their partner.”

The events occurred on September 21, 2018 when a group of six friends of the victim rented a boat in Alicante to sail to Tabarca on a two-day outing. The trip was also attended by the accused, whom the victim did not know, and who had been invited by one of his friends because he had shared the training course with him to obtain the title of employer.

At trial, the accused has stated that it was the victim who “took the initiative” and who began to kiss him when they were both lying on the deck of the boat. “I was asleep and I noticed that she stood on top of me and started kissing me,” he stated before continuing that he later told her that she was cold, so he took her hand and led her to the cabin.

The man has maintained that he expressed his concern about the fact that they did not have a condom, to which she reproached him for his objections, and has added that the next morning, when he woke up, she was no longer with him and that he was when he went out on deck when he noticed that she was angry, to which he offered to accompany her to a pharmacy to buy the morning after pill, once in port.

The Prosecutor's Office initially requests a six-year prison sentence for the defendant and the defense requests free acquittal in a hearing that will continue tomorrow with other statements and presentation of expert reports.
