A fourth possibility would be to give approval in Spain as a whole to a prior agreement on independence or a new status, through a constitutional reform. The fifth option is a double referendum, one in Catalonia and another in Spain, with two different demos. The academics also point out that there must be clear and preferably binary questions, and an agreement on the acceptance of the results a posteriori and that the effects be limited beforehand. The group of nine academics is inspired by the ruling of the Supreme Court of Canada on the secession of Quebec and emphasizes that it “rejects the existence of a unilateral right” to secession while a potential agreement, via negotiation, must respect the principles of democracy, rule of law, constitutionalism, federalism and protection of majorities. Likewise, it is advocated to harmonize all these principles and not prioritize one over another.
