The Barcelona Court orders to review whether Netflix violated Rosa Peral's right to honor

Rosa Peral's battle against Netflix for the broadcast of the series 'The Body on Fire' is reactivated again. The Court of Barcelona has forced the Vilanova court to accept the lawsuit filed by the woman convicted of the crime by the Urban Police for alleged violation of her right to honor and that of her daughters. Now, after this decision, the court will have to go into the substance of the matter and will have to study whether the Arcadia Motions Pictures production violated the right to honor of both Peral herself and her daughters.

A few days before the premiere of the series 'The Body on Fire', on September 8, 2023, Peral filed a lawsuit in case the series threatened her honor and that of her daughters. At the same time he demanded the stoppage of the premiere because he wanted to see it first. The Vilanova court rejected everything. Both the acceptance of the demand and the precautionary measure to paralyze the premiere.

After the setback, Peral presented an appeal to the Barcelona Court, which has now agreed with him. He believes that the court should have admitted the lawsuit and should have ruled on whether to accept or reject the stoppage of the premiere. It was not enough to ignore everything. For this last procedure, before deciding, he should have summoned the parties - Peral's lawyer and Netflix - to present their arguments for or against stopping the premiere, something he did not do either. "Claims, whatever their type, can only be inadmissible for processing exceptionally and when the law expressly establishes it," the order states.

Rosa Peral's lawyer, Núria González, tells La Vanguardia that with this hearing decision "the process begins again" and now it must be studied whether the series violates the convicted woman's right to honor. At the same time, it is also considered to request precautionary measures again such as the stoppage or suspension of the series even though the production has already been released and millions of people have seen it.

Rosa Peral is serving a 25-year prison sentence for murdering her boyfriend Pedro Rodríguez along with her lover, Albert López. The murderers and the victim were agents of the Barcelona Urban Police.
