First conviction for street harassment after the entry into force of the 'only yes is yes' law

First conviction for street harassment after the entry into force of the 'only yes is yes' law

The Court of Instruction 5 of Seville has convicted a 60-year-old man of a minor crime of sexual harassment who masturbated in the street in front of two girls whom he urged to give him fellatio. The facts were recorded and served as evidence in the trial that has led to the first conviction for street harassment after the entry into force of the law of only yes is yes.

Luis F.D., 60, has been sentenced to 30 days of permanent location and to compensate the two young women with the "symbolic" amount of 100 euros for moral damages for having committed a minor crime of sexual harassment.

The Superior Court of Justice of Andalusia reported on Monday the content of the sentence that was sent on June 15. The prosecution had requested those 30 days of location for the convicted person and a six-month restraining order, in addition to compensation of 1,000 euros for each of the victims.

At trial, the man acknowledged the facts and explained that his mental state at that moment did not allow him to be "aware of his actions" that he said he did not remember. Despite this, he apologized to the victims during the hearing.

This is the first conviction for street harassment after the entry into force of the law of only yes is yes. The law proposed by the Ministry of Equality, and later reformed through the votes of the PSOE and right-wing parties, raised controversy at the beginning for lowering sentences for some sexual crimes.
