The Juvenile Court of Almería has issued a 200-meter restraining order that prevents the student from the (IES) Celia Viñas de Almería from approaching and communicating with the victim who allegedly hit a classmate, who has lost vision in one eye as a result. of aggression. Judicial sources have explained to EFE that said precautionary measure was adopted this Monday at the request of the Juvenile Prosecutor's Office and the private prosecution, carried out by lawyer Leo Marfil, as well as that the alleged aggressor is charged with a crime of injuries and another crime. against moral integrity.
As explained by these sources, the events took place on March 11 when, according to the testimony of the victim, the alleged aggressor began to insult him in class. According to his testimony, these insults had been going on for a long time, and fed up with this attitude, he summoned him to speak in the hallway at the change of classes.
Apparently, the victim grabbed the aggressor by the chest, who punched him shortly after. At this point, the statements of both differ, since the attacked person assures that he did not previously hit the investigated person, while the latter assures that he head-butted him that preceded him hitting him.
In any case, both admit that this punch occurred and that the victim fell to the ground, so that he subsequently had to go to the Torrecárdenas University Hospital in Almería, where he was diagnosed with optic neuropathy in his left eye that caused total loss of vision in said world.
The victim, who in the best of cases could recover 20% of vision, according to his lawyer, is undergoing psychological treatment because he has a “high level of anxiety, depression and inability to go to class, interact with his classmates. and continue with your studies.”
Leo Marfil has told EFE that his client's older brother already told the center's management that he was the target of insults prior to the alleged attack, which occurred during "a class change, with teachers in the hallway" and without “anyone helping” the student. “There are a series of factors that increase the possible liability of the center, and the Ministry and the center have been called as jointly responsible civil parties,” the lawyer stated.
The aggressor was expelled from the IES Celia Viñas for six days and was forced to participate in an awareness course, but at the moment no other measure has been adopted in this area, because the victim has not returned to class.
The Delegation in Almería of the Ministry of Educational Development and Vocational Training sent a statement yesterday in which it expressed its "most resounding and firm rejection" of any "lack of respect, aggression or manifestation of violence" that threatens the integrity of any member. of the Almeria educational community. It expressed its "firm condemnation of this serious act against coexistence" and that all the appropriate procedures and measures had been activated to guarantee compliance with the rules of "organization, positive coexistence and discipline of the teaching center."
The delegate of the Department of Educational Development in Almería, Francisco Alonso, has detailed that disciplinary measures have been taken towards the aggressor student, while support and home care have been provided to the attacked student.
