The so-called Demon Case returns to the Seville courtrooms with an unexpected twist in its history. This time, the Prosecutor's Office has requested the file of the case against the two agents from Seville who killed the criminal known as the devil while he was robbing a supermarket in the southern town with an armed hand.

The Prosecutor's Office considers that no criminal responsibility can be demanded in the face of an "extremely violent robbery" carried out by two "dangerous" criminals and with numerous records that caused "a real risk" for the people who were in the supermarket, as confirmed the Seville newspaper.

The event occurred last July 2021, in Seville. As confirmed by the agents, one of the robbers entered the establishment with a barreled shotgun and even fired several shots. The demon unleashed a panic in the supermarket and it was at that moment that the police officers appeared at the premises, after several calls from those who were inside.

With this decision, the Prosecutor's Office distances itself from the position of the investigating judge number 8 of Seville, Reyes Flores, who had prosecuted the police for the second time for the crime of reckless homicide, after having repealed his previous decision to sit in the bench to the two agents.

The Prosecutor's Office indicates that the agents had an "immediate reaction to a threat and fired in just three seconds, when it could not be ruled out that the robber was carrying another weapon or that he had other intentions in fleeing into the interior, and the people who still were inside -staff and clients, including minors, children- could be in serious danger".

The judge highlights "that the agents found themselves in a threat not only against property, but against the life and safety of multiple people, which puts the Police in the obligation to act without pursuing a purpose contrary to the norm." She adds that "it seems clear that the agents acted in the line of duty" since, in addition, their conduct was "reasonably necessary" before an armed person.

In these circumstances, the prosecution maintains that the police action "does not imply a disproportion in the defense of the citizens", but considers that when entering the supermarket "the advisable thing was not done", since the instruction of the Corps ensures that the agents They should not enter the place of the robbery but the Criminal Procedure Law establishes the "obligation" to arrest the criminals at the moment.

The Prosecutor has requested the file of the case with reservation of possible actions, since even if the police protocols had not been followed and "the actions of the local police officers may be irregular and, where appropriate, it is not criminally relevant," it indicates.
