21 of the 26 minors in the Almendralejo case are attributable

21 of the 26 minors in the Almendralejo case are attributable

The minors section of the Badajoz Provincial Prosecutor's Office is finally investigating 26 minors for their alleged involvement in the Almendralejo nudes case, as reported yesterday by El Periódico de Extremadura. The minors used artificial intelligence (AI) to retouch photographs of around thirty minors.

Five of them are under 14 years old and therefore cannot be held accountable, but the rest can be held criminally responsible in accordance with the law on minors. The senior prosecutor of Extremadura, Francisco Javier Montero, explained in said newspaper that “we will have to see what the participation of each person is in the events, because receiving (the images) is not the same as saving them or making use of them by transmitting them to third parties. "That is why it is important to verify the role of participation in these events, which we have no doubt are criminal."

The punishment for committing this crime may vary depending on age. For this reason, the Prosecutor's Office must archive the case of the five minors under 14 years of age because they do not have sufficient capacity to receive criminal responsibility. Despite this, social services must investigate whether the crime may be due to the minor's family or social environment.

The remaining 21 cannot be sentenced as an adult, since they are minors, between 14 and 17 years old. The sanction that can be imposed on the 21 attributable minors can range from doing work for the benefit of the community, therapy up to eight years in juvenile centers for the most serious crimes.

From now on, the Police must listen to the statements of those involved, review the cell phones of those investigated and the photographs that the minors retouched. In addition, psychological, educational and school reports will be requested to which these minors attend.
